BCT-The case of Crowdfunding
Blockchain can transform SME financing by improving transparency, reducing intermediary costs, and enabling secure, tokenized investments through smart contracts. However, inconsistent EU regulations and legal uncertainties around tokens limit its potential. Key recommendations include harmonizing crowdfunding laws, clarifying digital asset status, and supporting innovation through regulatory sandboxes and education.
BCT for Energy Applications
Blockchain enables secure, decentralized peer-to-peer energy trading and smarter demand-side management in microgrids. It improves transparency, coordination, and flexibility in integrating renewable energy, but faces technical hurdles like the blockchain trilemma (scalability, security, decentralization). Legal and regulatory structures for blockchain-based energy systems are underdeveloped, requiring clearer market frameworks and policy action.

This brief highlights the tension between fast-moving digital innovation and slower, static legal frameworks. Legal systems must adapt to decentralized technologies like blockchain, NFTs, and smart contracts while safeguarding fundamental rights, data privacy (especially under GDPR), and ethical use of AI. Key challenges include redefining legal categories, ensuring regulatory compatibility, and addressing new risks in cybersecurity and digital asset inheritance.
